LA DA Hesitates to Lock Up a Child Rapist Because the Rapist is Trans

Think that the vicious criminals who rape 10-year-olds should be, at the very least, locked up for a long, long time and have to suffer what they may in prisons? Well, you’re not alone; most sane people would also respond affirmatively.

Unfortunately, many of the leftist DAs that are turning America’s cities are not sane. They, instead of focusing on protecting law-abiding citizens from the horrific acts of violence committed by demented, evil criminals, are worried about “rehabilitation” and treating brutal thugs with kid gloves.

One example of such pro-criminal sentiment comes from LA, where DA George Gascon is hesitating to prosecute a 26-year-old that raped a 10-year-old because the rapist is a transgender. And that’s despite the rape being truly horrific. Here’s what the Daily Mail reports happened:

A mentally disturbed transgender woman who pleaded guilty to sexually assaulting a 10-year-old girl could be allowed to serve her sentence under house arrest, after the Los Angeles County district attorney refused to prosecute the 26-year-old as an adult for the crime committed shortly before their 18th birthday.

[…]Tubbs was a boy named James when, on New Year’s Eve in 2014, he spotted a 10-year-old girl at a Denny’s in Palmdale, California.

He followed the girl into the bathroom, held her by the throat and forced his hand down the girl’s pants. He only stopped when someone came into the restroom, and then ran away before he could be stopped. He was two weeks off his 18th birthday at the time – with Gascon refusing to sentence Tubbs as an adult because the defendant was 17 when the attack took place. 

A man raped a 10-year-old while choking her and might not even be thrown in jail, much less treated as harshly as those that abhor such crimes think he should be.

Why? Is the mitigating factor better behavior, some amend having been made, or anything else that could conceivably make a light sentence be anything other than a dereliction of duty to the victim?

No, Tubbs, the rapist who admitted to the rape, won’t be thrown in the slammer but will rather be kept on house arrest or, worse yet in a juvenile facility because the DA wants to go soft on transgenders. Again according to the Daily Mail:

Gascon has said that he will not press for jail time in an adult facility, as the crime was committed while Tubbs was a minor.

Tubbs instead faces a stay at a juvenile custody facility – even though she is too old for juvenile hall – or will be granted probation at a court, according to the LA Times. 

[…]Gascon told the outlet he was concerned Tubbs could be victimized in an adult facility as a trans woman and said a probation report recommended she be sentenced to home confinement. 

The result, predictably, has been outrage. For example, the Daily Mail reports that Kathryn Barger, a woman on an LA district’s board of supervisors, said “It’s useless to catch criminals like Hannah Tubbs if we don’t follow through and seek justice for victims such as the 10-year-old girl she sexually assaulted,’ said Barger…Where is the justice for her young victim and her family?

Where indeed. As Ayn Rand once said “Pity for the guilty is treason to the innocent.” Nowhere is that truer than here; because an LA DA is more worried about the safety of some transgender child rapist than the child who was raped, justice won’t be served.
